Oricon Top Unit Sales Ranks

The numbers don’t line as Japanese music chart Oricon reveals Top 5 in 2010 unit sales. From gross annual sales that accountants album,DVD and singles.

2. TVXQ (9.431 billion yen)

3. AKB48 (7.092 billion yen)

Amazing enough both Korean base artists TVXQ(Tohoshinki); Kara and SNSD are place. With Kara leading the way for new artist sales. SNSD not slagging to far behind. Mega J-pop idol groups like Arashi, AKB48, and EXILE continue to advance.

SM Pay Out or Shut UP

Since last year DBSK/TVXQ/Tohoshinki activities have been place on hold.JaeJoong,Yoochun,and Junsu(fab 3) have file lawsuit against their own mega label SM entertainment.The controversy was spark when 13 year contract agreements didn’t go so smoothly with the 3 members.Who are demanding a better but fair deal.Ending their original contract and leaving the group quite divided on the issue.

The Fab 3 have went to court and even started their own mini group JYJ.SM was in total disagreements from the first trails which cause a second hearing.Either both parties must settle or continue this costly legal battle.The fab 3 are demanding some 3 billion won (2.5 million USD).According to article DBSK has earn some 60 Billion won from first contract ending October 2009.The fab 3 wanted each member to at least receive 10 billion won,leaving SM with 10 billion won.A fair deal everyone breaks even but SM doesn’t agree.Then the fab 3 lower their deal in half by only wanting 3 billion won(2.5 million USD).SM still claiming a large sum of the money but not a 13 year contract agreement.Fab 3 defend themselves by saying

“SM Entertainment claims that 13-year-long contract is needed for overseas activities, but it’s unacceptable. We members are the ones who have to pay for the damage if the contract is broken in any way, and its amount is too high to be acceptable.”

The Fab 3 are only demanding a tenth of the total gross earning from the first contract.Wise move but will SM  accept this new proposal and swallow the lost of a 13 year contract agreement? Ending any attempts to slam the fab 3 with any outrageous fines for ending the first contract agreement by filing a lawsuit.Money isn’t everything I think the fab 3 have come to realize but has SM?

JYJ New DBSK?

DBSK lawsuit against SM has not settle out or reach a final verdict this has place a delay on all DBSK/VXQ/Tohoshinki activities.Avex entertainment an affiliate to SM in Japan has move forward and allow Jaejonng,Yoochun and Junsu continue as a trio.Despite Yunho and Changmin staying faithful to SM during this lawsuit proceeding.

JYJ is a make up of JaeJoong,Yoochun,and Junsu names. Avex is holding a special concert just for Japanese fans.Taking place at Osaka Dome 5-6th and another held at Tokyo Dome 12-13 of June.Thus far tickets are sold out with a million participants within two days.

Don’t fret this doesn’t indicate the end of DBSK for good.For the moment this gives an opportunity for fans to enjoy the fab 3 minus SM holding them back.

DBSK VS SM Round Two Continues…

Last year DBSK members JaeJoong,Junsu,and Yoochun file suit against SM entertainment for “better wages.” Because of this has stop all activities associated with DBSK/TVXQ/Tohosinki and with Japanese label Avex Entertainment.According to SM DBSK was paid “fairly” compare to other agencies.

TVXQ 3 Members “The unfairness of the contract is grave” vs SM “The way we treat TVXQ is not bad compared to other agencies”

Three members of TVXQ (Xiah Junsu, YoungWoong Jaejoong, Micky Yoochun) and SM Entertainment had their first hearing today regarding an objection to the verdict on a contract suspension injunction that was made last year, and were unsuccessful in closing the gap between their conflicting stances.

The legal representatives of the three members of TVXQ and SM met at the Seoul District Courts at 5 p.m. on the 7th to state their stances on the lawsuit made by SM Entertainment regarding an objection to the contract suspension injunction verdict.

This hearing was held after SM filed for the lawsuit on April 12th as an objection to the partial acceptance verdict made by the Courts last year.

At the hearing, SM’s representative stated, “Compared to other agencies in Korea, TVXQ’s income division is not unfair,” and emphasized that TVXQ’s income division was not a pressing issue in the exclusive contract.

The representative also strongly questioned the three members’ action of signing a separate contract with their Japanese agency AVEX although only the contract suspension injunction, not the actual lawsuit, had been partially accepted by the Courts.

On the other hand, the three members’ representative stated, “The length and the income division section of the exclusive contract between SM and TVXQ is so unfair that the situation is very grave.”

The judge in charge of the hearing (Judge Choi Sung Joon) questioned both sides of the possibility of a settlement, but no groundbreaking outcome came of it.

The Courts asked both sides whether a settlement could be made if the contract was fixed but received different answers.

When the Courts asked both sides if a settlement would be possible if the Courts shortened the length of the exclusive contract and if the income division was made more equal SM’s representative said “Yes, a settlement would be possible,” but the three members’ side gave a skeptical answer and said, “The three members have lost their faith in SM and they think negatively of the prospect of working with the agency again.”

However, the three members’ side stated near the end of the hearing that, “If SM’s desires for a settlement are sincere, then I will talk to the three members and will report back to the Courts.”

On the other hand, Kim Young Min and Nam So Young attended the hearing as SM and SM Japan’s representatives respectively but none of the members of TVXQ attended. The Courts will examine all files submitted by both sides till the end of this month and reach a verdict regarding SM’s objection to the contract suspension injunction verdict.

I knew its either SM has to lose and allow DBSK out of their contract without penalties our settlement there is no other option.I hope both parties choose to settle and SM pays up to DBSK regardless the dollar amount.

DBSK VS SM Round Two

The on going battle between DBSK/TVXQ/Tohoshinki verse SM entertainment continues even though former president Lee Soo Man retired.During the mist of this lawsuit and after Hankyung (Super Junior) file.

The lawsuit between TVXQ members, YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu, and SM Entertainment will begin on May 7th.

SM Entertainment took action against the three members of TVXQ and filed for an objection to the verdict on the contract suspension injunction as well as a verification of the continued existence of the exclusive contract. The first hearing for this lawsuit will be held at the Seoul District Courts on May 7th in the afternoon.

On this day, only the legal representatives of the two side will be attending the hearing. As this is a civil suit, the three members will not be participating in the trial.

The three members of TVXQ filed for a contract suspension injunction against SM Entertainment on July 31st, 2009 to the Seoul District Courts and were rewarded with a partial acceptance verdict on October 27th.

At the time, the Courts stated, “SM can no longer sign contracts regarding any TVXQ activities without notifying the members beforehand. SM must also not interfere with any individual activities the members of TVXQ wish to pursue.”

Then, SM filed a lawsuit against the three members on April 12th, 2010 objecting the verdict to the contract suspension injunction and asking for a verification of the continued existence of the exclusive contract. SM also called for the three members to pay 2.2 billion Won in compensation.

SM’s representative stated, “After the injunction, we have tried hard to continue TVXQ’s existence so we have kept this lawsuit aside. However, as the three members did not give an official statement regarding future TVXQ activities and as TVXQ’s Japanese activities were suspended, we have decided to go ahead with the lawsuit.”

The court are in favor of DBSK but SM is still fighting to have control.Let me remind you that SM has control over DBSK name,music, image and distribution of profit shares.JaeJoong,Junsu,Yoochun are fighting to claim control over their profit shares to have more power.For the moment DBSK/TVXQ/Tohoshinki remains inactive until there is some final verdict by the courts or a settlement.

Big Bang &Tohoshinki VMAJ Battle it Out In Japan

Big Bang and Tohoshinki(TVXQ) are battling it out on MTV Wold Stage Music Awards Japan happening on 29th of May.

Big Bang is nominated in three categories: Best New Artist Video for “Gara Gara Go,” Best Pop Video for “Koe wo Kikasete (Let Me Hear Your Voice)” and Best Collaboration Video for Japanese group w-inds collaboration with G-Dragon, leader of Big Bang.

TVXQ is nominated in the Best Group Video category for “Share the World”.

In the Best New Artist Video category, Big Bang will be going up against Mao Abe, Keri Hilson, Taylor Swift and The Telephones.

Besides Big Bang, other nominees in the Best Pop Video category are Leona Lewis, Ikimono Gakari, P!NK, and Koda Kumi.

W-inds and G-Dragon’s video is competing against Beyonce, Jay-Z, Juju with JAYed, and Shimizu Shota with Kato Miriya.

TVXQ will be up against Backstreet Boys, Black Eyed Peas, Remioromen and Tokyo Jihen.

Big Bang will perform in the awards ceremony along with Japanese groups EXILE and w-inds.

K-pop girl group 2NE1 will also grace the event as guest together with Vaness, Miho Fukuhara and Masato.

Rumors are flying around the possibility for Tohoshinki being able to attend sense all group activity has been stop.Cross your fingers kids.

SM STFU

I don’t know what is more annoying the fact this lawsuit between SM and the fab 3 has been going on forever. JaeJoong,Yoochun, and Junsu are still battling SM entertainment for fair wages.As the scenario unfolds SM decides to file against the fab 3 injunction.

SM might try to play dirty by filing agaisnt the fab 3 but I doubt they’re gonna win.Although SM has halt not only Tohoshinki activities over in Japan but also DBSK/TVXQ because they own the name.The boys can not promote their bands names until this lawsuit is settle.In result each member has started doing solo activities via appearing on TV dramas and modeling to stay a float. The whole point of this lawsuit was to earn better paying wages and profit shares.It only seems fair at this point SM should allow the boys to have  a little more green in their pockets.

The boys are busy starting their individual careers but the cloud of uncertainty wavers so heavily over fans head.There is no plans to shut down fancafes both in Korea and in Japan.I guess in these dark times all you can really do is support and wish for the best outcome.
